Agreement to These Terms
These Terms of Service ("Terms") are a binding agreement between you and Haiven Labs LLC ("Haiven," "we," "us"), a company registered in the state of Utah, United States. They govern your access to and use of the Haiven applications, websites, and services (together, the "Service").
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.
01 Eligibility
You must be at least 18 years old to create an account and use the Service. By using Haiven, you represent that you are 18 or older and that you have the legal capacity to enter into these Terms. The Service is not directed at children, and we do not knowingly allow anyone under 18 to create an account.
02 What Haiven Is — and Is Not
Haiven is a non-clinical, self-reflection and behavioral insight tool. It helps you observe patterns across your daily check-ins, journal entries, and (optionally) wearable data, and surfaces those patterns back to you in plain language.
Important — Not Medical or Clinical Care
Haiven is not a medical device, and it does not provide medical, psychological, psychiatric, or therapeutic advice, diagnosis, or treatment. It is not a substitute for professional care or for the judgment of a licensed clinician. Nothing in the Service should be interpreted as a clinical assessment or as a recommendation to start, stop, or change any treatment.
If you are experiencing a medical or mental health emergency, or are concerned about your safety, contact your local emergency services or a crisis line immediately. In the United States, you can call or text 988 to reach the Suicide & Crisis Lifeline. Haiven cannot provide emergency help or clinical care.
Any decisions you make about your health, behavior, or care are your own responsibility, and you should consult a qualified professional where appropriate.
03 Your Account
You are responsible for the information you provide, for keeping your login credentials secure, and for all activity that occurs under your account. Notify us promptly at hello@haiven.co if you believe your account has been accessed without authorization. You may close your account at any time.
04 Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms
- Attempt to access another user's account or data
- Reverse engineer, disrupt, or compromise the security or integrity of the Service
- Use the Service to provide clinical or medical care to others as though it were a regulated medical device
- Upload content that is unlawful, infringing, or that you do not have the right to share
05 Your Content and Data
Your journal entries, check-ins, and the insights derived from them are yours. You retain ownership of the content you create in Haiven.
You grant Haiven a limited license to store and process your content solely to operate and improve the Service for you — for example, to compute your signal, generate insights, and produce reports you choose to share. We handle your data as described in our Privacy Policy. We do not sell your data, and we do not permit it to be used to train third-party AI models.
06 Sharing and Practitioner Features
Haiven lets you share a summary of your signal and selected patterns with a practitioner or other person you choose. You control what is shared and can revoke access at any time. Practitioners who use Haiven do so to support — not replace — their own professional judgment, and remain solely responsible for the care and advice they provide to their clients. Haiven is not a system of record for medical or clinical documentation.
07 Subscriptions, Billing, and Cancellation
Some features of the Service are offered on a paid subscription basis. Pricing and billing terms are presented to you before you subscribe. Paid subscriptions renew automatically for the same period unless cancelled before the renewal date. You can cancel at any time, and cancellation takes effect at the end of the current billing period. Except where required by law, payments are non-refundable. We may change pricing on a going-forward basis with reasonable notice.
08 Third-Party Services
The Service integrates with third parties such as wearable providers, authentication, hosting, and AI infrastructure. Your use of those integrations may be subject to the third party's own terms and privacy policies. We are not responsible for the practices of third-party services, and connecting them is optional.
09 Intellectual Property
The Service, including its software, design, branding, and content (excluding your content), is owned by Haiven Labs LLC and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for your personal, non-commercial use, subject to these Terms.
10 Disclaimers
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any insight it surfaces will be accurate, complete, or suitable for any particular decision. Haiven measures conditions and surfaces patterns — it does not promise outcomes.
11 Limitation of Liability
To the fullest extent permitted by law, Haiven Labs LLC and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from or related to your use of (or inability to use) the Service. To the extent liability cannot be excluded, our total liability is limited to the amount you paid us for the Service in the twelve months preceding the claim.
12 Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or use the Service in a way that could cause harm or legal exposure. On termination, your right to use the Service ends; sections that by their nature should survive (such as ownership, disclaimers, and limitation of liability) will survive.
13 Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you in-app or by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
14 Governing Law
These Terms are governed by the laws of the State of Utah, United States, without regard to its conflict-of-laws principles. Any disputes will be subject to the exclusive jurisdiction of the courts located in Utah, unless otherwise required by applicable law.
